Order in Council 1260 - Expansion of Yarmouth Wharf


Since Confederation construction of infrastructure in tidal waters requires approval of the Dominion of Canada.

In 1912, the DAR requested approval for an expansion of the Evangeline Wharf (Yarmouth Wharf) including a larger wharf, a larger freight shed, and a new railway approach trestle and track. The approval was granted in a Federal Order in Council number 1260 of the year 1912. (Orders in Council are numbered beginning from number 1 each calendar year.)

Below is the text of the approval signed by the Prime Minister and the Governor General and including text recitals of the water-lot concerned and the details of the location of the railway trestle and track. Of interest is the information that the Evangeline Wharf was located north of Lovitt Street. Also included is a scan of the plan submitted for approval.

On a Memorandum dated 14th May, 1912, from the Minister of Public Works, submitting that the Dominion Atlantic Railway Company have applied, under section 233 of the Railway Act, for approval of descriptions of site and plan of their proposed wharf extension, with pile trestle approach thereto, at Yarmouth, N.S.

The Minister states that the District Engineer of the Department of Public Works has reported that there is no objection to the approval of the application in so far as the interests of navigation are concerned, and in this report the Chief Engineer has concurred. The Minister, therefore, recommends that authority be granted for the approval of the attached descriptions of site and plan of the wharf extension, with pile trestle approach there to, which the Dominion Atlantic Railway Company propose to construct at Yarmouth, Nova Scotia.

The Committee submit the same for approval.

PC1260 (a)

Description of site of proposed extension to Dominion Atlantic Railway Company's Wharf at Yarmouth in the Town of Yarmouth, County or Yarmouth, Province or Nova. Scotia, being a portion of the water lot West of Water Street and North of Lovett Street produced, and being described as follows:—

Commencing at the North East corner of the Dominion Atlantic Railway Company's Wharf, thence Northerly on a course being the production of the Easterly limit of said wharf, two hundred and eighteen feet more or less to the Northerly limit of said Railway Company's property, thence Westerly along said Northerly limit sixty-two feet, thence Southerly in a right line five hundred and eighteen feet more or less to a point on the Southerly limit of said wharf produced, said point being distant thirty-six feet Westerly from the South West corner of said Wharf, and said distance being measured along said production of said Southerly limit, thence Easterly, along the last mentioned production, thirty six feet to said South West corner, thence Northerly along the Westerly limit of said Wharf two hundred and ninety-eight feet to the North West corner of said Wharf, thence Easterly along the Northerly limit of said Wharf forty feet to the point of commencement. This site containing an area or twenty-three thousand seven hundred and forty square feet more or less.

Description of site for proposed Pile Trestle and Track for the Dominion Atlantic Railway Company's Wharf at Yarmouth in the Town or Yarmouth in the County of Yarmouth and Province of Nova Scotia — a railway track and trestle leading from a point on the existing railway track on Water Street to the Southerly limit of the Dominion Atlantic Railway Company's Wharf, the centre line of said track being described as follows:—

Commencing at a point on the centre line of the Dominion Atlantic Railway Company‘s track on Water Street, said point being distant two hundred and sixty feet Northerly from the intersection of said track and the Northerly limit produced of the Dominion Atlantic Railway Company's property, and said distance being measured along the centre line of said track, thence South Westerly on a curve to the right of three hundred and eighty-three point one feet radius, two hundred and sixty-five feet to a point in the said Northerly limit of said Railway property, thence still South Westerly on a curve to the left of three hundred and eighty-three point one feet radius, two hundred and twenty feet, thence Southerly parallel to and distant fifty-six feet Easterly from the Westerly limit of the Dominion Atlantic Railway's Wharf as constructed two hundred and ninety-five feet to the southerly limit of said Wharf

A drawing was included with the approval. The scan does not allow details to be made out but some information can be seen.

The then-existing wharf facilities and track are shown in the darkest tone. A freight shed and a coal shed exist on the DAR Wharf. A single spur line line of railway track serves the wharf. Another spur line serves an adjacent wharf.
The then-proposed wharf expansion and expanded freight shed and new trestle and track were shown in red colour - these scan as lighter grey. They show the trestle alignment that matches what is seen in subsequent photographs, such as File:Yarmouth Wharf Postcard.jpg. The two and a half story building marked "Dominion Atlantic Railway" shown in that picture is not included in the 1912 approval.

Order in Council 1377 - Subsidy - Completion Date of Weston Branch Extended to 1914


In February 1912 the DAR was awarded a subsidy for construction of the Weston Branch. The work was required to be completed by the 1st of August, 1913. In this Order in Council the required completion date was extended one year, to 1st August 1914. The approval was granted in a Federal Order in Council number 1377 of the year 1912. (Orders in Council are numbered beginning from number 1 each calendar year.) Below, for search purposes, is the text of the Order in Council. A digital scan of the OIC follows the text.

The Committee of the Privy Council, on the recommendation of the Minister of Railways and Canals, advise that the Order in Council of the 20th February, 1912, authorizing entry into a subsidy agreement with the Dominion Atlantic Railway Company for the construction of a line of railway from Centreville, on their railway, westerly to Weston, not exceeding 15 miles, be amended to the effect of fixing the time for the completion of the railway in question as of the 1st of August, 1914, the full time limit allowed by the Railway Subsidy Act, instead of the 1st of August, 1913, as set down in such order, the Company having applied for such extension of time.

Order in Council 2037 - Revised Alignment and Bridge at Avon River - Windsor


The DAR applied for approval of a revised alignment and a new bridge over the Avon River at Windsor in 1912. The approval was granted in a Federal Order in Council number 2037 of the year 1912. (Orders in Council are numbered beginning from number 1 each calendar year.)

On a memorandum dated 15th July 1912, from the acting Minister of Public works, stating:-

That the Dominion Atlantic Railway Company have applied, under Section 233 of the Railway Act, for approval of the attached plan showing the replacement, by a new structure, of their bridge crossing the Avon River at Windsor N.S.;

That the District Engineer of the Department of Public Works has reported, with the concurrence of the Chief Engineer, that there is no objection to the plan of the proposed new structure, provided that the applicant Company remove the old piers when the new work is completed.

The Minister, therefore, recommends that the attached plan submitted by the Dominion Atlantic Railway Company of the replacement of their bridge crossing the Avon River at Windsor, N.B., be approved provided that the applicant Company remove the old piers when the new work is completed.

The committee submit the same for approval.

Order in Council 2502 - Bear River Bridge Replacement - Federal Land Acquisition


In 1912 the DAR was preparing for replacement of the bridge over Bear River and to ease an approach curve a small portion of land owned by the Federal Department of Marine and Fisheries was asked to be purchased. Approval of the request was granted in Order in Council 2502. The text of the Order in Council is shown below for search purposes, with a scan of the document included below that.

On a Memorandum dated 6th September, 1912, from the Minister of Marine and Fisheries stating that, he has had under consideration an application from the Dominion Atlantic Railway Company for a grant of a portion of the lighthouse reserve at Bear River, Digby County, N.S., being the south-easterly portion of said reserve, containing 1/3 acre, more or less, as shown on plan attached, coloured pink, which land is required by the said Railway company to give them a better approach to an improved railway bridge spanning Bear river. [The plan was not included with this scan - editor.]

The Minister observes that the Chief Engineer of the Department of Marine and Fisheries reports that the granting of the said application would in no way prejudicially affect the interests of the Department in the said lightstation, and he recommends granting the application on payment by the company of the sum of $25.00 being a fair proportion of the purchase price originally paid for the lighthouse reserve; the said Railway company also paying all legal, survey and other expenses in connection with the grant.

The Minister, therefore, recommends that a grant do issue to the Dominion Atlantic Railway Company or the portion of the lighthouse reserve at Bear river, Digby County, N.S., above described, on the terms mentioned.

The DAR applied for approval of a revised alignment and a new bridge over Allen's Creek at Annapolis in 1912. The Order in Council mentions a plan No. 46707 attached to the report, but the Library and Archives Canada source does not include a scan of this plan. The approval was granted in a Federal Order in Council number 2753 of the year 1912. (Orders in Council are numbered beginning from number 1 each calendar year.)

Order in Council 2764 - Reconstruction of Big Joggins Bridge, Annapolis County


The DAR applied for approval of the reconstruction of the bridge at Big Joggins in Digby County. The Order in Council mentions a plan No. 44365 attached to the report, but the Library and Archives Canada source does not include a scan of this plan. The approval was granted in a Federal Order in Council number 2764 of the year 1912. (Orders in Council are numbered beginning from number 1 each calendar year.)

September, 1912, from the Minister of Public Works, submitting that the Dominion Atlantic Railway Company have applied, under Section 233 of the Railway Act, for the approval of a plan (No 44,362) showing the proposed reconstruction of their bridge at Big Joggins, Digby County, N. S.,

The Minister states that the District Engineer of the Department of Public Works has reported that he has made the necessary examination in the matter, and has recommended that the plan in question be approved, on the understanding, however, that such approval will not in any sense or degree absolve the company from the obligation to preserve, maintain or provide proper facilities in the shape of warping piers or dropping piers for the passage of vessels through the draw span. The Chief Engineer has concurred in the District Engineer's report and recommendation.

The Minister, therefore, recommends that authority be granted for the approval of the attached plan (No 44,362) showing the proposed reconstruction by the Dominion Atlantic Railway Company or their bridge at Big Joggins, Digby County, N. S., such approval, to be granted on the understanding above mentioned.

The DAR applied for approval of the replacement of the bridge over the Moose River in Annapolis County. The Order in Council mentions a plan No. 46365 attached to the report, but the Library and Archives Canada source does not include a scan of this plan. On a memorandum dated 30th. September, 1912, from the Minister of Public Works submitting that the Dominion Atlantic Railway Company has applied, under Section 233 of the Railway Act, for approval of the attached plan No. 46365, of the replacement of Moose river bridge, County of Annapolis, Province of Nova Scotia:

That the District Engineer of the Department of Public Works, has reported that he does not see any objection to the approval of the plan with the understanding that such approval shall not absolve the Company from the obligation to provide and maintain proper facilities in the shape of dropping piers or warping piers, to enable vessels to pass safely through the draw span. The Chief Engineer of the Department has concurred in this recommendation.

The Minister, therefore, recommends that authority be granted for the approval of the attached plan No. 46365, submitted by the Dominion Atlantic Railway Company, for the replacement of the Moose river bridge, County of Annapolis, Province of Nova Scotia, subject to the conditions set out in the District Engineer's report already mentioned.
