Order-in-Council 643 of year 1895


In 1895, the DAR requested permission to lay a single track extending from the shore-line 440 feet out onto the government wharf at Digby. The approval was granted in a Federal Order in Council number 643 of the year 1895. (Orders in Council are numbered beginning from number 1 each calendar year.)

Below is the text of the report to the Governor General for his approval, signed by the Prime Minister and the Governor General.

On a joint Report. Dated 4th March 1895, from the Ministers of Public Works and of Marine & Fisheries, submitting that the Dominion Atlantic Railway Company have applied for permission to extend their railway track on the Government Wharf at Digby N.S.

The Ministers state that the Chief Engineer of the Department of Public Works, to whom the matter was referred, to ascertain whether the wharf was sufficiently strong to bear the strain of use for railway purposes, reported that there could not be any objection to the request made by the Dominion Atlantic Railway Company being granted, provided the Company would not be

be allowed to lay more than one track on the wharf, said track to be laid on the position shown in blue lines on the plan hereto attached, and not to extend on the pier more than 440 feet from the shore line, and provided also, that the Company, before proceeding with their work, will submit to the Department of Public Works, to be approved, a sketch showing the manner in which they intend laying down their rails.

The Ministers recommend that authority be given to permit the Dominion Atlantic Railway Company to lay one track on the Digby Pier, N.S. said track to extend

to extend not more than 440 feet from the shore line in the manner above specified and in the position shown on the plan, hereto attached, said permission to be given to the Company subject to the provisions of sections 3 and 7 of Chapter 84, Revised Statutes of Canada.

The Committee advise that the requisite authority be granted.
