1894 Nova Scotia Chapter 28 - An Act respecting the Yarmouth and Annapolis Railway Company, formerly called the Western Counties Railway Company

An Act was approved by the Nova Scotia legislature on February 12, 1894 to allow the Yarmouth and Annapolis Railway some more time to make final payments of money owed to the Province and to the municipalities of Digby and of Annapolis.

Chapter 28.

An Act respecting the Yarmouth and Annapolis Railway Company, formerly called the Western Counties Railway Company.

(Passed the 12th day of February, A. D., 1894.)

Summary of the sections of the Act:

Recitals - mentions an act passed in 1893 (Chapter 46 of the Acts of 1893) which set out some arrangements for payments to the Government of Nova Scotia of some money due to the Western Counties Railway to pay some obligations the company then had to the Government. There were changes made following the passage of the act, using Orders-in-Council, that required legislative ratification made by this current Act.

Section 1 - approved an Order-in-Council of September 30, 1893, and an Order-in-Council of December 7, 1893.

Schedule

  • Contained the text of the September 30, 1893 Order-in-Council. It stated the company had determined it would not be able to pay the agreed sum by November 30, 1893. The Government therefor proposed the following sums to be paid before or on November 30: $65,000 for the Government of Nova Scotia, $10,000 for the municipality of Annapolis, and $10,000 for the municipality of Digby. For the balance owed, the syndicate controlling the railway would have until May 1st, 1894 to pay the amount plus applicable interest.
  • Contained the text of the December 7, 1893 Order-in-Council. It stated the required installment of $85,000 to be made by November 30, 1893 was not actually made until December 5, 1893. Because of the minor delay, the September Order-in-Council was amended to make the deadline December 5, 1893.
