1878 Nova Scotia Chapter 54 - An Act further to amend the Act to incorporate the Western Counties Railway Company, and the Acts in amendment thereof
An Act was approved by the Nova Scotia legislature on April 4th, 1878 to allow the Western Counties Railway to build iron bridges instead of wooden bridges. This required additional money to be raised, which this amendment also permitted. Summary of Chapter 54 of the Acts of 1878
An Act further to amend the Act to incorporate the Western Counties Railway Company, and the Acts in amendment thereof.
Passed April 4, 1878
Section 1 - Substituted a new text for Section 5 of Chapter 71 of the Acts of 1877. The new text authorized the construction of iron rather than wooden bridges, and allowed for debentures of a value up to £780,000 sterling to be issued to cover additional costs.
Section 2 - Ratified actions taken under the old section 5 as being valid under the new section 5 of Chapter 71 of the Acts of 1877.
Section 3 - Authorized the company to execute a new deed of trust or mortgage to secure the repayment of the newly authorized debentures.
Section 4 - The new deed of trust or mortgage was to be read so as to satisfy certain provisions of previous acts regarding a deed of trust or mortgage.
Section 5 - Any debentures issued or to be issued were valid notwithstanding any irregularity in holding meetings of shareholders.
Section 6 - Security of five hundred thousand dollars, already provided by the Western Counties Railway Company, was to be renewed before the current Act went into operation.
