Order in Council 1354 of year 1897
In 1897, the DAR requested permission to extend the already existing railway siding on the Digby government wharf. The approval was granted in a Federal Order in Council number 1354 of the year 1897. (Orders in Council are numbered beginning from number 1 each calendar year.)
Below is the text of the report to the Governor General for his approval.

On a Report dated 19th May 1897, from the Minister of Public Works, stating that on the 13th March, 1895, an Order-in-Council was passed authorizing the Dominion Atlantic Railway Company to extend their railway track on the Government wharf at Digby, provided the Company would not be allowed to lay more than one track on the wharf; that the said track would not extend on the pier more than 440 feet from the shore-line, and also that the Company would submit before proceeding with their work a sketch showing the manner in which they propose to lay their rails.

Company have again applied for permission to lay their tracks a further distance of 205 feet on the Digby wharf, that is to say, to the end of the solid crib work portion of the pier, and the Chief Engineer of the Department of Public Works reports that the permission in question can be granted on condition that the Company will lay plank to the full height and that between and outside of the rails in the same manner as they have done on the portion of the track already laid.
The Minister recommends that authority be given on the condition recommended by the Chief Engineer of the Department of Public Works.
The Committee submit the above recommendation for your Excellency's approval.

Order in Council 3449 of year 1897
In 1897, the DAR was billed by the Federal Government $2,121.83 for dredging work at the company's Saint John, N.B. wharf done by the government dredge “New Dominion”. The company asked the amount be reduced because some of the work benefited the public at large. A Federal Order in Council number 3449 of the year 1897 approved a reduced amount of $1,000.00. (Orders in Council are numbered beginning from number 1 each calendar year.)

On a Memorandum dated 21st October, 1897, from the Minister of Public Works, stating that in 1896 the Dominion Atlantic Railway Company, whose headquarters are at Kentville, Nova Scotia, requested the Department of Public Works to cause some dredging to be done at their wharf at St. John, New Brunswick, by the Government Dredge “New Dominion” they agreed to pay all the expenses of the dredge while engaged in this work, and relieving the Department from all responsibility should any damage be done to

to their wharf by the dredge and that the request having been granted by the Department of Public Works, the dredge above mentioned was put to work to do the dredging required by the Company.
The Minister further states that when the work was completed, the Chief Engineer of the Department of Public Works, transmitted to the Department to be collected from the Company. an account amounting to $2,121.83 which he stated represented only the actual cost of the work performed by the “New Dominion” for the Company, adding that the 15,525 cubic yards of material

material which were dredged had been removed at the very low figure if 13½ cents per cubic yard.
The Minister further states that the Company having been asked to pay the account in question, represented that they should not be called upon to pay the whole of that account inasmuch as the work done at their wharf was more in the interests of the public at large than in their own, and that, therefore, the amount to be collected from them should be limited to what would represent the advantages they themselves would derive from the work done.

The Minister further states that the Department of Public Works, having taken into consideration the representations of the Company, with the object of ascertaining what would be a fair sum to charge the Company in view of the fact that the work would greatly benefit the public at large, arrived at the conclusion that the sum of $1000. would fairly cover the extent of the advantage to be derived by the Company from the work.
The Minister recommends in view of the foregoing that authority be given to accept from the Dominion Atlantic Railway Company the sum of $1000. in full

full and final settlement of the Government's claim against them for dredging done at their wharf at St. John, New Brunswick, by the dredge “New Dominion” in 1896 the total cost of which was placed by the Chief Engineer of the Department of Public Works at $2,121.83.
